Terms of Service

1. Acceptance of Terms
By accessing or using the Orbit platform and Devotel APIs, you agree to be bound by these Terms of Service. If you are using the services on behalf of a company or organization, you represent that you have the authority to bind that entity.
2. Use of Services
You may use our services to send and receive communications via SMS, Voice, WhatsApp, RCS, and Email channels. You agree to use these services in compliance with all applicable laws and regulations, including telecommunications, privacy, and anti-spam legislation.
3. Account Security
You are responsible for maintaining the confidentiality of your account credentials, including API keys. You must immediately notify Devotel of any unauthorized access to your account. Devotel is not liable for losses caused by unauthorized use of your credentials.
4. API Usage & Rate Limits
API access is subject to rate limits based on your subscription plan. Exceeding rate limits may result in temporary throttling. You agree not to circumvent rate limits or use the APIs in a manner that could impair the service for other users.
5. Billing & Payment
Usage-based charges are billed monthly. You are responsible for all charges incurred under your account, including API usage, phone number subscriptions, and AI agent compute time. Failure to pay may result in suspension or termination of your account.
6. Intellectual Property
All intellectual property rights in the Orbit platform, including software, documentation, APIs, and trademarks, are owned by Devotel. You retain ownership of any content you transmit through the platform. You grant Devotel a limited license to process that content solely to deliver the services.
7. Prohibited Use
You may not use the platform to send unsolicited messages (spam), transmit malicious content, impersonate others, violate any applicable law, or interfere with the platform's operation. Devotel reserves the right to suspend accounts that violate these restrictions without prior notice.
8. Service Level & Availability
Devotel strives to maintain high availability but does not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance. SLA commitments, where applicable, are defined in your subscription agreement.
9. Limitation of Liability
To the maximum extent permitted by law, Devotel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunity, arising from your use of the platform. Our total liability shall not exceed the amounts you paid to Devotel in the twelve months preceding the claim.
10. Termination
Either party may terminate this agreement at any time. You may close your account through the dashboard settings. Devotel may suspend or terminate your access if you breach these terms. Upon termination, your right to use the platform ceases immediately. Data deletion follows the schedule outlined in our Privacy Policy.
11. Changes to Terms
We may modify these Terms of Service at any time. Material changes will be communicated via email or an in-app notice at least 30 days before they take effect. Continued use of the platform after changes take effect constitutes acceptance of the revised terms.
12. Governing Law
These terms are governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these terms shall be resolved in the courts of Istanbul, Turkey.
